I am wondering about copyright issues in using the Ice Cream Bunny's likeness.

I am writing and illustrating a graphic novel, primarily centered around a dream I had a few years ago about Hell. Imagine The Inferno as if it had been written reinterpreted by Fyodor Dostoevsky, Christopher Hitchens, Louis C.K., and David Lynch.

I would really like to feature The Ice Cream Bunny driving around a surrealist nuclear wasteland in his ridiculous fire-truck. He will not be named. Am I allowed to do this? And if it requires permission, who should I request it from?

I believe it's in the spirit of Rifftrax, and I really really need it to happen. It is the crux on which the entire narrative hinges! (Not really, but I would get an unbelievable kick out of doing it).

It might fall under parody, which means you're protected as far as using it goes, but give credit. If Ice Cream Bunny if public domain (and I believe it is) you're in the clear. Also, a guy in a white bunny costume driving a fire truck could be anyone.
I survived the San Diego Comic Con 2010 Hall H stabbing.

Awesome, thanks. I'm going to operate under that assumption until someone says otherwise.
